Council of Ministers<\/strong><\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the memorandum received from the General Secretariat of the Council of Ministers, No. 7\/B\/11236 dated 8\/9\/1421 AH, which includes the decision of the Supreme Economic Council, No. 21\/9 dated 7\/9\/1421 AH, regarding the reorganization of student rewards in higher education sectors with the aim of rationalizing them, as well as approving the establishment of the Higher Education Fund in accordance with the attached regulation of the decision.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the decision of the Higher Education Council No. 12\/2\/1419 dated 29\/2\/1419 AH, regarding amending the provisions of articles (41, 42) of the regulation governing financial affairs in universities related to the regulation of student rewards in universities<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the decision of the Supreme Economic Council No. (21\/9) dated 9\/7\/1421 AH, mentioned above.<\/p>\n

Decides the following:<\/strong><\/p>\n

1. Reorganizing student rewards in higher education sectors with the aim of rationalizing them so that they are not paid in the following cases:<\/p>\n

A- Rewards of students who have exceeded the regular period for completing their studies.<\/p>\n

B- Rewards of students who have apologized for studying or who have requested to postpone it according to the regulations governing it.<\/p>\n

C- Rewards of all students during the summer vacation, except for those registered for a summer semester, and the Higher Education Council shall determine the date of application of this clause.<\/p>\n

D- Rewards of students who have been given academic warnings according to the regulations governing it.<\/p>\n

2. Approval of the establishment of the Higher Education Fund - according to the attached regulation -.<\/p>\n

3. Continuing to approve student rewards in the annual budgets of universities in the coming years according to the actual number of students in the last academic year at the time of issuing this decision.<\/p>\n

4. This decision and the attached regulation are published in the Official Gazette and shall be effective from the date of issuance of the general budget of the State following the date of its issuance.<\/p>\n

The Supreme Economic Council<\/strong><\/p>\n

\u00a0\u00a0\u00a0\u00a0After viewing the transaction received from the Bureau of the Minister Council with No. 7\/B\/11011 dated 3\/9\/1421 AH which includes cable of His Royal Highness Minister of Interior No. 1\/S\/6683 dated 13\/6\/1419 AH which includes reference to the approval of the members of the ministerial committee formed under the Royal Decree No. 7\/B\/7544 dated 1\/6\/1419 AH on the draft minutes of the meeting of the Higher Education Council No. 12\/2\/1419 dated 29\/2\/1419 AH concerning amendment of the provisions of the two articles (41 and 42) of the bylaw regulating financial affairs at universities as related to awards of students at universities.<\/p>\n

Decides the following:<\/strong><\/p>\n

1. Reorganizing student allowances in higher education sectors with the aim of rationalizing them so that they are not paid in the following cases:<\/p>\n

A- Allowances for students who have exceeded the regular period to complete their studies.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the memorandum received from the Office of the Presidency of the Council of Ministers, No. 6721\/B dated 15\/2\/1427 AH, including the letter of the Secretary-General of the Supreme Economic Council No. 60\/M\/27 dated 15\/2\/1427 AH, attached to it is the decision of the Supreme Economic Council No. (5\/27) dated 14\/2\/1427 AH regarding the reorganization of the allowances of students of technical colleges affiliated to the General Organization for Technical Education and Vocational Training, and students of colleges and health institutes affiliated to the Ministry of Health.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the decision of the Council of Ministers No. (216) dated 8\/9\/1421 AH.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the minutes No. (221) dated 23\/5\/1427 AH, prepared in the Advisory Board of the Council of Ministers.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the minutes taken by His Excellency the Minister of Labor, Chairman of the Board of Directors of the General Organization for Technical Education and Vocational Training, and His Excellency the Minister of Higher Education.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the decision of the Supreme Economic Council No. (5\/27) dated 14\/2\/1427 AH.<\/p>\n

\u00a0\u00a0\u00a0\u00a0After reviewing the recommendations of the Permanent Committee of the Council of Ministers No. (419) dated 6\/7\/1427 AH, and No. (562) dated 18\/8\/1427 AH.<\/p>\n

Decides the following:<\/strong><\/p>\n\n

  1. Applying the paragraphs (1) and (3) of the decision of the Council of Ministers No. (216) dated 8\/9\/1421 AH to students of technical colleges affiliated to the General Organization for Technical Education and Vocational Training and students of colleges and health institutes.<\/li>\n \t
  2. A technical and vocational education account is established in the Higher Education Fund and is paid out of this account by a decision of the Board of Directors of the General Organization for Technical Education and Vocational Training.<\/li>\n \t
  3. A special account is allocated for colleges and health institutes in the Higher Education Fund, and is paid out of it by a decision of the Board of Directors of the Fund.<\/li>\n \t
  4. Adding a representative of colleges and health institutes, and a representative of the General Organization for Technical Education and Vocational Training to the membership of the Board of Directors of the Higher Education Fund.<\/li>\n<\/ol>\n

    \n\t\t\t\t
    \n\t\t\t\t\t
    Article Thirteen<\/span><\/a>

    Article Thirteen<\/span><\/span><\/h3>\nWithout prejudice to the right of the General Auditing Bureau to monitor the Fund\u2019s account, the Board of Directors shall appoint one or more auditors from among natural or legal persons licensed to work in the Kingdom and shall determine their fees. If there are multiple auditors, they shall be jointly responsible for their work before the Fund, and a report shall be submitted. The auditor refers to the Board of Directors, and provides the General Auditing Office and the Higher Education Council with a copy thereof.<\/div><\/div>Article Twelve<\/span><\/a>

    Article Twelve<\/span><\/span><\/h3>\nThe fund may invest a percentage of its funds as determined by its board of directors to realized returns supporting its revenues.<\/div><\/div>Article Eleven<\/span><\/a>

    Article Eleven<\/span><\/span><\/h3>\nThe fund may not engage in new projects unless amounts sufficient to those projects are provided.<\/div><\/div>Article Ten<\/span><\/a>

    Article Ten<\/span><\/span><\/h3>

    Each university is allocated a special account within the fund from which its revenues are monitored and from which it is spent on its requirements and to meet its basic needs, such as:<\/p>

    1. Scientific and academic programs of universities.
    2. Establishing new colleges and expanding existing colleges.
    3. Financing the purchase of equipment and providing laboratory requirements.
    4. Funding programs, centers, scientific research and scholarships at universities.
    5. Providing the urgent needs of university hospitals.<\/p>

    When necessary, the Board of Directors may transfer from one account to another.<\/p><\/div><\/div>Article Nine<\/span><\/a>

    Article Nine<\/span><\/span><\/h3>

    The Fund's resources consist of:<\/p>

    1. The amounts realized by universities from rationalizing student remuneration and organizing them according to the rules established for rationalizing remuneration.
    2. Fund interest retained from previous years.
    3. Returns on investing the Fund\u2019s money.
    4. Returns from the use of university facilities and the financial returns allocated to universities in exchange for the services, studies and research they provide.
    5. Money allocated by the state to the fund.
    6. Gifts, donations and bequests that the Board of Directors decides to accept.
    7. Other financial resources determined by the Board of Directors.<\/p><\/div><\/div>    Article Eight<\/span><\/a>

    Article Eight<\/span><\/span><\/h3>\nThe fund will have a separate and independent annual budget, and the fund\u2019s fiscal year starts with the state financial year.<\/div><\/div>Article Seven<\/span><\/a>

    Article Seven<\/span><\/span><\/h3>

    The Fund will have a Secretary-General chosen by the Minister of Education from among the teaching staff at universities for a renewable three-year term. He is the executive responsible for managing the Fund and his authority is the Board of Directors. His responsibilities are focused within the limits of what is stipulated in the organization and what is approved by the Board of Directors. The Secretary-General exercises the following powers:<\/p>

    1-. Preparing for Board of Directors meetings.
    2- Follow up and implement decisions issued by the Board of Directors.
    3- Preparing the Fund\u2019s draft budget, draft final account, and annual report on the Fund\u2019s activity.
    4- Supervising the Fund\u2019s employees in accordance with the powers granted to it and what is determined by the regulations.
    5- Submitting periodic reports to the Board of Directors on the Fund\u2019s work, achievements and activities.
    6-. Proposing the Fund\u2019s plans and programs and supervising their implementation after approval by the Board of Directors.
    7-. Issuing orders for the Fund\u2019s expenses according to the approved annual budget.<\/p><\/div><\/div>    Article Six<\/span><\/a>

    Article Six<\/span><\/span><\/h3>\nIn its relations with other entities, and before the court, the fund will be represented by the chairman of fund board of directors or a person authorized by him.<\/div><\/div>Article Five<\/span><\/a>

    Article Five<\/span><\/span><\/h3>\nThe Board of Directors meets at the invitation of its Chairman at least twice a year. The Chairman must invite the Board if at least half of the members request it. The invitation letter must include the agenda. The meeting\u2019s validity requires the presence of the majority of members, including the Chairman of the Board. Decisions are issued by a majority of the votes of those present. In the event of With equal votes, the side with which the President votes will prevail. The Council may invite to attend its sessions whomever it deems necessary to benefit from their information and experience, without them having the right to vote. The Council\u2019s deliberations and decisions are recorded in minutes signed by the Council President and its attending members.

    \n\nThe Council may not issue decisions by presenting them to separate members except in cases of necessity. In this case, all Council members must agree to the decisions in writing, and these decisions must be presented to the Board of Directors at the first subsequent meeting to be recorded in the minutes of the meeting.<\/div><\/div>    Article Four<\/span><\/a>

    Article Four<\/span><\/span><\/h3>\nThe Fund\u2019s The Board of Directors is the authority responsible for its affairs, administration, and the conduct of its activities. It is responsible for setting the general policies that it operates under according to this regulation, which contributes to meeting the urgent needs for the development of universities, increasing their capacity, and enhancing their capabilities. In particular, it has the following powers:

    \n\n1. Approving the annual budget of the Fund.
    \n2. Approving the projects and programs funded by the Fund and monitoring their implementation. In the case of projects that entail the creation of jobs or ongoing operational expenses not budgeted for that fiscal year, the concerned university shall discuss these projects with the Ministry of Finance and National Economy. Once an agreement is reached, the Board of Directors of the Fund shall determine the start date of implementation.
    \n3. Approving the necessary plans for utilizing the financial resources of the Fund.
    \n4. Approving the organizational structure of the Fund and appointing the administrative body.
    \n5. Issuing the administrative and financial regulations necessary for the operation and management of the Fund in a manner that achieves its objectives.
    \n6. Accepting donations, grants, and bequests.
    \n7. Approving the final accounts and the annual report on the Fund's activities for presentation to the Higher Education Council before submitting it to the Prime Minister, as per the regulations.\n<\/div><\/div>    Article Three<\/span><\/a>

    Article Three<\/span><\/span><\/h3>\nTaking into account what was stated in Royal Decree No. M\/54 dated 19\/10\/1407 AH, the Fund shall be managed by a Board of Directors headed by Higher Education and with membership of:\n\n1-. A representative of the Ministry of Finance and National Economy\n2- A representative of the Ministry of Planning\n 3- Three members representing universities chosen by the Minister of Education\n4- Three businessmen chosen by the Minister of Education who have academic and professional qualifications.<\/div><\/div>Article Two<\/span><\/a>

    Article Two<\/span><\/span><\/h3>\nThe Fund enjoys moral personality and administrative and financial autonomy, and its headquarter will be in Riyadh city.<\/div><\/div>Article One<\/span><\/a>

    Article One<\/span><\/span><\/h3>\nPursuant to this regulation, a fund called \u201cHigher Education Fund\u201d is established to develop higher education in universities and increase their ability to play their role in line with the requirements of development. It aims to diversify funding sources and develop their mechanisms, increase self-resources, empower universities to continue rationalizing allowances and organizing them, investing their money, benefiting from the proceeds of the services they provide, and absorbing the contributions of the private sector in financing programs, centers, and scholarships within those universities.<\/div><\/div><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
